由於許多雇主喜歡用LINE聯絡工作事項，日前就發生有電子業勞工休假時還接到雇主的LINE交付工作，因而在遭解雇後，向雇主索討加班費，最後雇主遭判須付加班費。對於一則訊息要算4小時加班，台北市長柯文哲12日受訪時表示，「哪有這麼真皮包包推薦好賺」，許多問題還需多方探討。

也喜歡用LINE聯絡市政工作的柯文哲上午出席動物園「植樹暨插秧活動」，會後受訪時說，對於LINE加班的問題，會蒐集一下相關資訊再看怎麼處理，還是會有個規範，但也不贊成下班還「LINE個不停」。

不過，對於休假日雇主傳一則LIN要算「4小時加班」，柯文哲也忍不住直呼：「哪有這麼好賺的」；至於一例一休的爭議，他認為，前3個月還是宣導期，還有各種陳情、檢舉，待將問題蒐集整理後，再輔導企業主改進，不會直接開罰，等3個月結束後，再看還有哪些需要、改進，再進一步修改規則。

由於一例一休勞資新法上路，強制規定勞工休假，若要勞工加班，雇主須給付加班費，也讓加班費的核定規範出現些許問題與爭議，然而，日前一名新北市電子業助理春節前遭解雇，認為自己權益受損，除要求精神賠償外，另外也提出相關加班費給付要求；最後，新北市勞資爭議仲裁委員會根據勞方提供的通訊紀錄後，認定雇主應給加班費，以1封訊息至少1分鐘計算，勞工平日加班358分鐘、假日加班1007分鐘，雇主該給付2598元給勞工。

依勞動部函釋，勞工在事業場所外工作指導原則，加班應以實際勞務提供的起訖時間計算，而依LINE的對話頻率、次數、內容及通話秒數，工作時間至少以1分鐘計算；不過，依照一例一休新法規定，休假日加班未滿4小時仍需以4小時計薪，至於LINE訊息交付工作，即便是1分鐘，也同樣得以4小時計算加班費。
